The petroleum and petrochemical industry, as a major pillar of the national economy, has achieved sustained and rapid development in recent years. Since 2010, the industry's total economic output has ranked second in the world, after only the United States. The total output value of petrochemicals exceeds that of the United States, ranking first in the world. This represents a historic leap. With the rapid development of the industry, the strategic awareness of intellectual property rights in the petroleum and petrochemical industry has been continuously enhanced. During the 13th Five-Year Plan period, a "3+2+N" intellectual property rights demonstration service system for the petroleum and petrochemical industry was initially formed, comprehensively supporting the protection and utilization of intellectual property rights in the industry.

Innovative service models support the intellectual property work of the petroleum and petrochemical industry

(1) Constructing a "3+2+N" model to establish a basic industry intellectual property service system

The China Petroleum and Chemical Industry Federation (hereinafter referred to as the "Petrochemical Industry Federation") has long explored innovative intellectual property work, initially forming a "3+2+N" intellectual property framework. This serves as a demonstration for the petroleum and petrochemical industry's intellectual property service system. "3" refers to the "Intellectual Property Rights Working Committee of the China Petroleum and Chemical Industry Federation," the "National Petroleum and Petrochemical Patent Network," and the "Petroleum and Chemical Industry Patent Innovation Service Platform." "2" refers to bringing together a group of intellectual property service agencies and forming expert teams. "N" refers to the N professional service businesses, including patent mining and analysis, intellectual property evaluation, patent results transformation, intellectual property training, intellectual property policy publicity, and professional consultation.

(2) Establish benchmarks and strengthen the cultivation of intellectual property application capabilities

During the 13th Five-Year Plan period, the Petrochemical Federation actively participated in the Ministry of Industry and Information Technology's pilot program for the application of intellectual property rights by industrial enterprises. A total of 15 enterprises were identified as "pilot enterprises for the application of intellectual property rights," with 4 included in the benchmark demonstration list. The number of benchmark enterprises ranked among the top in various industries. Based on pilot cultivation, the Petrochemical Federation launched the "China Petroleum and Chemical Industry Intellectual Property Demonstration Enterprise" selection activity in 2017. Intellectual property demonstration enterprises are subject to dynamic management with a three-year review system. To date, 25 enterprises have been selected. These demonstration enterprises have played a typical exemplary role in driving the overall intellectual property level of the industry.

(3) Reward the advanced and encourage independent innovation

The Petroleum and Chemical Industry Association established the "Petroleum and Chemical Industry Patent Award." The award rate in 2017 was approximately 60%, with a 10% award rate for gold award projects. Each year, excellent projects that win the Petrochemical Federation's gold patent award are recommended for the China Patent Award. According to statistics, from 2015 to 2019, the Petrochemical Federation recommended 21 projects for the China Patent Award, with 14 winning, achieving a winning rate of 67%. This includes 2 China Patent Gold Awards, 1 Silver Award, and 11 Excellent Awards. The Petrochemical Federation won the Best Organization Award and the Excellent Organization Award from the State Intellectual Property Office in 2018 and 2019, respectively.

Providing full support to further improve the intellectual property development level of the entire industry

During the 14th Five-Year Plan period, the Petrochemical Federation will further improve the industry's intellectual property work mechanism, enhance its intellectual property service capabilities, and focus on five key tasks to help the industry become a strong petrochemical nation.

(1) Give full play to the functions of the intellectual property committee and continuously improve service capabilities

We will implement the series of reforms and deployments of the national intellectual property protection work, achieving systematic integration, collaborative promotion, and remarkable results. We will improve the top-level design of industry intellectual property services. We will connect with a wide range of industry professional service agencies and experts to strive to create a convenient public service system for industry intellectual property information. We will implement an industry intellectual property public service capability improvement project and strengthen the construction of industry intellectual property information and intelligent infrastructure. We will promote the standardization, precision, and intelligence of industry intellectual property services, reduce costs and increase efficiency, extend the service chain, and strive to provide high-quality, efficient, and excellent services to the industry.

(2) Conduct investigations and research and regularly publish annual industry intellectual property development reports

We will continue to strengthen investigation and research, improve industry IP information statistical analysis, clarify the industry status quo, and understand the current situation and precise needs of industry enterprises and scientific research units through a combination of questionnaires, information data analysis, and field surveys. Through research, we will select high-quality service agencies and high-level expert teams with industry characteristics from a large number of service agencies and personnel, and work together to provide high-level and efficient service quality for improving industry intellectual property.

(3) Strengthen intellectual property protection and create a good atmosphere for innovation and development in the industry

Establish a petroleum and petrochemical industry intellectual property protection center. Promote the implementation of the latest national laws and regulations, establish a patent infringement dispute handling mechanism with significant influence throughout the industry, and handle mediation work for major intellectual property disputes among relevant legal entities in the industry, reducing and avoiding unnecessary intellectual property litigation, and creating a good atmosphere of mutual respect for intellectual property rights. Actively participate in and respond to intellectual property disputes in international trade disputes, and serve enterprises in strengthening overseas intellectual property protection and emergency rescue. Assist the government in legal management, strictly review the outward transfer of intellectual property rights involving industries related to national security, and improve international intellectual property risk warning and emergency mechanisms. Strengthen publicity and education and public welfare training to enhance the strategic awareness of respecting and protecting intellectual property rights throughout society.

(4) Establish an industrial intellectual property operation center to ensure the smooth transformation of high-value patent technology results

Establish a petrochemical intellectual property operation center and build a petrochemical intellectual property and scientific and technological achievement property rights trading platform. Market-oriented and with intellectual property operation as its aim, the center will carry out petroleum and petrochemical intellectual property operation services to accelerate industrial transformation and upgrading and achieve innovation-driven development. This will include precise intellectual property navigation for the industry, the construction of industry patent pools, and improving the industry's capacity for original innovation and invention. It will also establish a management system for the valuation of intangible assets such as industry patents and trademarks, develop intellectual property management services for small and medium-sized enterprises, and promote "government, industry, education, and research funding." It will integrate multiple subjects and multiple elements, including intellectual property investment and financing services. It will break through the barriers to the transformation of patented technological achievements, clear the "last mile," carry out industry-wide intellectual property, technology transfer, licensing and other operational services, and comprehensively build and optimize the structural and operational industrial ecosystem mechanism to ensure the smooth transformation of high-value patent technology results.

(5) Systematic training and talent cultivation to improve the industry's overall strategic awareness and operation level of intellectual property
